1. Definition
In this condition, “Company” means PT. Padang Kencana, “Customer” means a person or company that enters into a contract with the Company as the purchaser of Goods and “Goods” means dry ice, which is the subject of online transactions between the Company and the Customer.
2. Effective Date: July, 2018
These Terms apply to all online transactions made by the Company and supersede all previous Terms in the form issued by the Company.
3. General
Any online transaction with the Company for the sale of Goods is subject to these Terms of Sale. All other terms, conditions and warranties that the Customer tries to introduce, whether express or implied are hereby excluded with the exception of those conditions which the Company expressly accepts in writing.
4. Law and Jurisdiction
The validity of the construction, performance and matters relating thereto will be governed in all respects by Indonesian Law and subject to the jurisdiction of the Indonesian Courts.
5. Order and delivery of goods through the website
5.1 Goods will be delivered or collected on the date specified to qualify for the agreed price. If the Company has agreed to deliver the Goods or provide them, the Company will use all reasonable efforts to do so according to the agreed delivery schedule. Time will not be of the essence for this clause.
5.2 If a customer places an order before 15:00, your order will be shipped on the next working day (D+1). If the order exceeds 15:00, it will be sent on D+2 at the time of placing the order.
5.3 Delivery is considered complete after the goods have been unloaded according to the address that has been informed by the customer
5.4 Error in inputting shipping address is not the responsibility of the company
5.5 Dry ice must be shipped in a styrofoam box. We provide styrofoam boxes to choose from according to your needs.
6. Price & Payment
6.1 The quoted price of goods is determined by the Company.
6.2 Payment must be made before the goods are processed and shipped
6.3 Shipping costs are determined by the system using the online motorcycle taxi application. The amount of postage is automatically agreed by the buyer and seller.
7. Weight
The company must prepare the weight according to the customer’s request. But because this is a shrinking item, the depreciation expense is outside the company’s responsibility.
8. Risk
The risk of loss / damage to the Goods and the risk of depreciation on the goods will be borne by the Customer at the time of delivery.
